Terms of Service

These Terms of Service ("Terms") govern your access to and use of [PRODUCT NAME] (the "Service"), operated by [COMPANY] ("we", "us"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

[PRODUCT NAME] converts an EPUB file you upload into a single-voice .m4b audiobook using third-party text-to-speech ("TTS") technology, and lets you download the result. Purchases are one-time, per book.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract. The Service is intended for individual, lawful use.

3. Access & identity

The Service is passwordless. You access your purchases via a one-time code (OTP) sent to your email address. You are responsible for maintaining access to, and the security of, the email address you use. Anyone with access to your email or an active session may access your audiobooks.

4. Your content and the rights you grant us

"Your Content" means the EPUB files and any text you submit.

  • You represent and warrant that you own Your Content or have all rights, licenses, and permissions necessary to upload it and to have an audiobook generated from it, and that doing so does not infringe any third party's rights or violate any law.
  • You grant us a limited, non-exclusive, worldwide license to store, process, transmit, and transform Your Content solely to provide the Service to you (e.g., parsing the EPUB and generating your audiobook). We do not claim ownership of Your Content.
  • We delete the uploaded source file after your audiobook is generated (see the Privacy Policy). We retain the generated audiobook so you can re-download it.

5. The generated audiobook

Subject to your compliance with these Terms and full payment, the audiobook we generate for you from Your Content is yours to use for your personal, lawful purposes. We hold the necessary commercial license over the TTS output that we deliver to you. You may not resell, redistribute, or publicly perform the generated audio except as permitted by applicable law and any rights you hold in the underlying work.

6. Acceptable use

You agree not to:

  • upload content you do not have the rights to convert, or that is unlawful, infringing, or harmful;
  • use the Service to violate any law or third-party right;
  • attempt to disrupt, overload, reverse-engineer, scrape, or circumvent the Service, its limits, or its security;
  • resell or commercially exploit the Service itself;
  • impersonate any person or misuse voices to deceive.

We may suspend or terminate access for violations.

7. Preview, pricing & payment

  • Before purchase you may generate a short audio preview to evaluate the voice. Previews are provided as-is and may be limited or rate-limited.
  • Prices are shown before you pay and are calculated from your selected chapters and voice. You authorize us (via our payment processor, Stripe) to charge the displayed amount. You are responsible for any applicable taxes.
  • Payment is processed by Stripe; your card details are handled by Stripe, not us.

8. Refunds

Refunds are governed by our Refund Policy, incorporated by reference.

9. Third-party services

The Service relies on third parties including, without limitation, TTS providers (e.g., ElevenLabs, Inworld), Stripe (payments), and infrastructure/email/analytics providers. Your use may be subject to their terms. We are not responsible for third-party services.

10. Intellectual property

The Service, including its software, design, and branding, is owned by [COMPANY] and protected by law. These Terms grant you no rights in our intellectual property other than the limited right to use the Service.

11. Disclaimers

THE SERVICE AND ALL OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that generated audio will meet your expectations, that the Service will be uninterrupted, or that stored files will be available indefinitely.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, [COMPANY] WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THE TRANSACTION GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless [COMPANY] from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms — including any claim that Your Content infringes a third party's rights.
